Terms of Service

1. Who we are
TalentMindAI is a recruitment software product operated by Smart4Talent, a DPIIT-recognised startup established in 2009 and operating in India. These Terms govern your use of TalentMindAI ("the Service") at talentmindai.smart4talent.com.
2. Your account
You must provide accurate information when creating an account. You are responsible for all activity under your account and for keeping your password secure. One account represents one organisation; each team member you invite acts on behalf of that organisation.
3. Plans, trials, and billing
TalentMindAI offers a Free plan (limited to 2 active job descriptions, 20 candidates, and 10 AI evaluations per month) and a Pro plan at ₹2,999 per month (billed monthly, unlimited usage). New Pro sign-ups include a 30-day free trial. You will not be charged during the trial. If you take no action, access may be limited to Free-plan limits at the end of the trial unless you add a payment method. Subscriptions renew automatically each month until cancelled. You may cancel anytime from Settings; cancellation takes effect at the end of the current billing period, and no partial-month refund is provided (see our Refund Policy).
4. Acceptable use
You agree not to: use the Service to discriminate against candidates on any legally protected basis; upload data you do not have the right to process; attempt to reverse-engineer, scrape, or overload the Service; or use the AI evaluation feature as the sole basis for a hiring decision without human review. AI-generated scores are a decision-support tool, not a final hiring determination.
5. Your data, your responsibility
You (the employer or recruiter) are the data controller for any candidate information you upload — names, resumes, contact details, and evaluation results. You are responsible for having a lawful basis to collect and process that candidate data under applicable law, including India's Digital Personal Data Protection Act, 2023. TalentMindAI acts as a data processor on your behalf, as described in our Privacy Policy.
6. AI evaluation feature
When you run an AI evaluation, relevant candidate and job description details are sent to Anthropic's Claude API to generate a match score, strengths, gaps, and recommendation. This happens only when you actively trigger an evaluation. We do not use your data to train any AI model.
7. Service availability
We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, and third-party services we depend on (database hosting, AI providers, OAuth providers) may occasionally be unavailable outside our control.
8. Limitation of liability
The Service is provided "as is." To the maximum extent permitted by law, Smart4Talent is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including hiring decisions made using information from the Service.
9. Termination
You may delete your account at any time from Settings, which permanently removes your organisation's data. We may suspend accounts that violate these Terms.
10. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.

Privacy Policy

1. What we collect
Account data: your name, work email, company name, and password (securely hashed by our authentication provider, never stored in plain text).
Candidate data you upload: names, emails, phone numbers, resumes/skills, work history, and any notes you add — entered by you or your team, not collected directly from candidates by us.
Usage data: pages visited, features used, and activity logs, used to improve the product and for support.
2. How we use your data
To operate the Service (store your job descriptions and candidates, run AI evaluations you request, show your dashboard), to communicate with you about your account, and to enforce plan limits. We do not sell your data or your candidates' data to anyone.
3. Who we share data with (our processors)
We use a small number of trusted infrastructure providers to run the Service:
- Supabase — our database and authentication provider. Your account data and candidate data are stored on Supabase's infrastructure with row-level security ensuring your organisation's data is isolated from other customers.
- Anthropic (Claude AI) — when you run an AI evaluation, the relevant job description and candidate details are sent to Anthropic's API to generate the evaluation. This only happens when you actively request it.
- Google / LinkedIn — if you choose to sign in with Google or LinkedIn, we receive your name and email from that provider to create your account.
We do not share candidate data with any other third party, and we do not use candidate data for advertising or marketing purposes.
4. Data storage and security
Data is encrypted in transit (HTTPS) and access is protected by row-level security so that no organisation can see another organisation's data. Passwords are never stored in plain text.
5. Data retention
We retain your data for as long as your account is active. If you delete your account, your organisation's data is permanently removed from our active database.
6. Your rights
Under India's Digital Personal Data Protection Act, 2023, and other applicable law, you may request access to, correction of, or deletion of your personal data by contacting us. As the employer, you are responsible for handling similar requests from candidates whose data you have uploaded.
7. Cookies
We use essential cookies/local storage to keep you signed in and remember your preferences. We do not use third-party advertising cookies.
8. Children's data
The Service is intended for business use by adults (recruiters and HR professionals) and is not directed at children.
9. Changes to this policy
We may update this Privacy Policy from time to time. Material changes will be communicated via the Service or email.

Refund & Cancellation Policy

1. Free trial
New Pro-plan sign-ups receive a 30-day free trial. No payment is collected during the trial, so there is nothing to refund if you cancel within this period.
2. Monthly subscription
The Pro plan is billed monthly in advance at ₹2,999. You may cancel your subscription at any time from Settings. Cancellation stops future billing but does not refund the current billing period — you retain Pro access until the end of the period you already paid for.
3. Refund eligibility
Because the Service is a usage-based software subscription with a full free trial period to evaluate the product before paying, we do not offer refunds for partial months or unused time within a billing period, except where required by law.
4. Billing errors
If you believe you were charged in error (e.g. duplicate charge, charge after cancellation), contact us within 30 days of the charge and we will investigate and refund confirmed errors in full.
